Nagar: The equations of sand smuggling, rising crime, and the sale and purchase of illegal weapons, especially village huts, are interdependent in Nagar district. Although the extraction and transportation of illicit secondary minerals cost billions of rupees, these crimes are not taken seriously. Therefore, the punishment for any other form of crime is less than the punishment for sand smuggling. Those accused of sand smuggling mainly benefit from the lack of coordination between the Treasury, police, RTO and the forestry department.

In the last ten years there have been 2,789 cases of sand smuggling. These have been submitted by the police and the revenue department. Crimes have been recorded under the Environmental Protection Law, including theft of sand and pimples. Charge sheets were filed in 2,679 cases. 2,487 cases are pending in court. The defendants in 255 cases were acquitted while only 26 defendants were convicted. The conviction rate for all types of crimes in the district is around 18%. The punishment for sand smuggling is much less. These are the figures presented by the police for the meeting of the State Level Surveillance and Monitoring Team on Minor Minerals.

A joint team of police, revenue, RTO and the forest department is not working to stop illegal mining and transport of secondary minerals. The responsibility for determining whether excavation is illegal rests primarily with revenue. The examples of joint action by the police and the Treasury are exceptional. While the number of attacks on government employees and officials by sand smugglers is on the rise, the number of law enforcement actions taken by the revenue squad is exceptional. Both the police and the revenue departments tend to take independent action. The reasons are different.

When a crime is investigated and a charge sheet is filed, the police do not know if the excavation is illegal, if the robbery site is valid or invalid, if the site is licensed, if the royalty receipt is true or false, if the excavator is a dealer. Most of the defendants in the case have been acquitted on the same issue and all of these issues are related to the revenue department. This means that the defendants are being released for lack of coordination even after the stolen secondary minerals have been seized.

The revenue department has taken 1,537 actions in the last three years. Of these, 184 cases were recorded. A fine of 15 crore 50 lakh was recovered. The district revenue department was given a target of Rs 140 crore for secondary mineral production last year, but got Rs 110 crore. The performance of the revenue department focuses mainly on the recovery of fines. The Subregional Transport Secretariat (RTO) has not suspended the license of any vehicle that transports illegal minerals in the last ten years. Compromise charges of around Rs 86 lakh were recovered from just 525 vehicles. The forest route is used for sand smuggling, but there is no example of action taken by the forest department.

No serious action is taken. Action is only taken when interest is damaged. It was restored that judgments are affected. It is being challenged in court, even if punitive measures are taken. However, under the law, action can be taken against sand smugglers. Not only the theft but also the robbery should be recorded.

Conversations have been held with the District Collector on the issue of coordination to curb illegal mining and transportation of minor minerals. Suggestions were also made at the meeting. Defendants have either been acquitted due to lack of coordination or the conviction rate for such offenses is low. Attempts are now being made to improve it.
