The editorial (May 14) reads ‘Question of Denial’. The case will now go to the Supreme Court after two Delhi High Court judges disagreed on whether forced sex in marriage should be treated as rape. There seems to be a debate going on about ‘women’s denial’, women’s self-esteem, her dignity and so on. However, even if the Supreme Court declares such a relationship to be ‘rape’ tomorrow, no one thinks much about how difficult it is to prove such ‘rape’ in court.

Given the seven key elements in the definition of rape under Section 375 of the existing Indian Penal Code, it can be easily seen that it is very difficult to prove marital rape. The court will ask for evidence to prove guilt. Serious crimes such as ‘rape’ against a husband cannot be proven solely on the basis of marital allegations.

Currently, there are seven conditions / options for defining such a relationship as ‘rape’.

1. Against her (wife) desires. – (Only one person can tell if someone has a ‘desire’ in a case. However, if the wife says in court that she has no desire, what evidence will she give him?! I mean, the thing is. Her word comes against her word. No one can prove it.)

2. Against her permission. – (There is a word ‘will’ instead of ‘permission’. The rest of the situation is the same. It is almost impossible to prove whether it is allowed or not.)

3. Getting her ‘permission’; But this permission was obtained by showing fear of death / injury to her or those close to her. – (After sexual intercourse, if a legal attempt is made to define the relationship as ‘rape’, some time will pass. Therefore, it is difficult to prove that the relationship was allowed out of fear of death / injury.)

4. By getting her permission, but this permission is based on ‘gardening’, i.e., the person in the relationship is really different, but she understands that he is her husband! – (In this case, the married woman could not even recognize her husband?

5. With her permission, but when she is mentally ill or addicted to drugs, she does not know what the consequences will be. – (In this case, mental health, drug use, etc. prevent her husband from proving the rape allegations. At the time of making these allegations, she was accused of having lost her mental health or was under the influence of drugs.)

6. ‘Permission’ or if she is under 18 years of age. – (This is the only condition on which a wife can easily prove ‘rape’ allegations against her husband in court. However, even in this case, the question may be asked whether you were married before you knew it.

7. She cannot in any way indicate when permission was granted. (Consent could not be communicated.) (This means only applies to deaf-mute, blind, or extraordinary people, so it is not very useful in the case of a normal marriage.

Therefore, all these discussions are purely ideological and in fact it is almost impossible to prove the allegations of marital rape against the husband in court.
